Event Rules


PLEASE BE AWARE THAT THESE EVENT RULES ARE IN ADDITION TO AND NOT A SUBSTITUTE FOR ANY RULES, REGULATIONS AND/OR WAIVERS REQUIRED BY BMW OF NORTH AMERICA IN CONNECTION WITH YOUR PARTICIPATION IN THE ULTIMATE DRIVING EXPERIENCE. FOR A COMPLETE LIST OF ULTIMATE DRIVER EXPERIENCE EVENTS (EACH, AN “EXPERIENCE EVENT”), VISIT BMWUSA.COM/UDE.

By choosing to participate in the Ultimate Driver Challenge (“Challenge”), you agree to any and all rules, regulations and waivers provided or required by BMW of North America (“Sponsor”) in connection with participation in the Ultimate Driving Experience (“Experience”) (incorporated herein by reference), these Ultimate Driver Challenge Event Rules (“Event Rules”) and the decisions of the Sponsor and judges which are final and binding in all matters.

You recognize that the operation of any motor vehicle is an inherently dangerous activity with a risk of loss of the motor vehicle and injury to you.

 
Who Is Eligible for the Challenge? In addition to the Experience Event eligibility requirements imposed by Sponsor (and included below), you must not have a felony on your driving record or any DUIs. .
 
Residents of Maryland and Colorado are only eligible to participate in the Autocross Finalist Competition and not the MCCC or MTD (both as defined below) Finalist Competitions.
 
Ultimate Driving Experience Event Eligibility Requirements: All driving programs, with the exception of the M Car Control Clinic and Teen Driving School, are for those 18 years of age and over with a valid driver’s license. For the Car Control Clinic, all guests must be at least 25 years of age. For the Teen Driving Clinic, guests may be between the ages of 15-20 with a valid permit or driver’s license. All guests, including non-drivers, must sign an event waiver at check-in; guests under the age of 18 require a parent or guardian signature. Guests under the age of 18 and not registered for Teen Driving School will not be permitted to ride along in any programs other than Street Drives. Management reserves the right to revoke driving privileges and to cancel or postpone driving activities at any time. Use of personal vehicles in any driving program is prohibited. Previous models are being shown.

Employees, representatives, freelancers and agents of Sponsor, its parent, subsidiaries, affiliates, BMW Centers and advertising and promotion agencies, and members of their immediate families (spouse, parent, children, siblings and their respective spouses, regardless of where they reside) and persons living in the same household, whether or not related, are not eligible to participate in this Challenge.

 
If you are selected as a Finalist (as more completely described below):
 
- Sponsor reserves the right to perform a background check, phone interview, and/or social media review with you. You agree to provide any verification or authorizations necessary in connection with background check. Sponsor will have the right, in its sole discretion, to disqualify you if the background check, phone interview, and/or social media review reveals conduct, information or history that, in Sponsor’s determination, may be harmful to Sponsor or Sponsor’s image or reputation, or with which Sponsor does not wish to be associated.
 
- You must maintain a valid driver’s license through the end of the Ultimate Driver Test (as described below). If your license expires between the Experience event at which you qualified as a Finalist and the Ultimate Driver Test at Thermal, CA. A renewed license must be obtained and submitted.
 
- You must be available to travel to Thermal, CA., to participate in the Ultimate Driver Test from December 2017 through February 2018.
 
 
Autocross Finalist Competition
 
Finalist Determination 
 
Round One:
Upon arrival at an Experience Event, drivers will be assigned a track. Drivers must complete the Autocross Clinic educational/training session to the satisfaction of the instructors before being allowed to participate in the timed lap. Each driver will complete one lap around his/her assigned track with an instructor present in the vehicle. Drivers must not deviate from the assigned course. 

Finalists will be determined at each track, approximately every two (2) hours during the Experience Event. At the conclusion of the applicable Experience Event, the driver with the fastest time around his/her assigned track, measured to 1/100 of a second, who finishes the course cleanly (as determined by the timing officials in their sole discretion) (e.g., driver stays on course, no cones were hit or knocked over during lap) will advance to Round Two (each, a “Finalist”). In the event no driver finishes the lap cleanly to the satisfaction of the timing officials, no one will advance to Round Two from that group. In the event of a tie, the tied drivers will complete another lap to determine who will advance to Round Two. Approximately six (6) drivers from each track will advance to Round Two.

A driver can only participate in one (1) Experience Event and can only participate in the Autocross Finalist Challenge one (1) time at such Experience Event.

Timing officials will record each driver’s lap with a stopwatch. Timing officials at each track will make the final determination of who advances to Round Two. Any attempt to bribe or sway these officials will result in automatic disqualification.


Round Two: 
Drivers who advance to Round Two will assemble at the track with the professional timing unit at a predetermined time. Drivers will be allowed to complete one (1) warm-up lap to familiarize themselves with the course, receiving advice from an instructor. Each driver will complete one or more laps. Number of laps will be standardized in each city. Drivers must not deviate from the assigned course.

For each cone hit by a driver, a 2.00 second penalty will be added to the driver’s overall time. All drivers’ times will be recorded and submitted electronically to the “Autocross Leaderboard.”

The driver with the fastest time in Round Two, as determined by Sponsor in its sole discretion, will be crowned as The Ultimate Autocross Driver of his/her respective city, and be invited to the Ultimate Driver Test in Thermal, CA. The driver with the second-fastest time in Round Two, as determined by Sponsor in is sole-discretion, will be the alternate driver for that Experience Event, and if The Ultimate Autocross Driver cannot attend the Ultimate Driver test in Thermal, CA., the alternate driver will be contacted. In the event of a tie, the tied drivers will complete a written timed test about the 5 Series to determine The Ultimate Autocross Driver of that city.

 


M Car Control Clinic (“MCCC”) FINALIST COMPETITION
 
MCCC drivers compete on a dedicated Car Control Clinic course, which will be equipped with a professional timing unit. The track will be recreated as needed, to exact specifications. Every driver participating in the MCCC event will have the opportunity to compete. Each driver will complete one practice lap. Drivers must not deviate from the assigned course. If a driver deviates from the course, 2.0 seconds will be added to their times for each hit cone. All drivers’ times will be recorded and submitted electronically to the “MCCC Leaderboard.”

The driver with the fastest time, as determined by Sponsor in its sole discretion, will be crowned as The Ultimate MCCC Driver of his/her respective city, and be invited to the Ultimate Driver Test in Thermal, CA. The driver with the second fastest time, as determined by Sponsor in its sole discretion, will be the alternate driver for that Experience Event, and if The Ultimate MCCC Driver of that city cannot attend the Ultimate Driver Test in Thermal, CA., the alternate driver will be contacted. In the event of a tie, the tied drivers will complete a written timed test about BMW M vehicles to determine The Ultimate Driver of that location.

 


M TRACK DAYS (“MTD”) FINALIST COMPETITION
 
MTD drivers compete on a dedicated Autocross course, which will be equipped with a professional timing unit. Every driver participating in the MTD event will have the opportunity to compete. Each driver will complete one practice lap and one official competition-timed lap. If a driver deviates from the course, 2.0 seconds will be added to their times for each hit cone and stopping outside the “stopbox.”  The top three drivers in each module will get on the leaderboard. Drivers must not deviate from the assigned course. All drivers’ times will be recorded and submitted electronically to the “MTD Leaderboard.”

The driver with the fastest time, as determined by Sponsor in is sole discretion, will be crowned as The Ultimate MTD Driver of his/her respective city, and be invited to the Ultimate Driver Test in Thermal, CA. The driver with the second fastest time, as determined by Sponsor in is sole discretion, will be the alternate driver for that Experience Event, and if The Ultimate MTD Driver of that city cannot attend the Ultimate Driver test in Thermal, CA., the alternate driver will be contacted. In the event of a tie, the tied drivers will complete a written timed test about BMW M vehicles to determine The Ultimate Driver of that location. 

 
FINALIST REQUIRMENTS: In addition to the Finalist requirements already set forth in these Event Rules, each Finalist:
 
- If requested by Sponsor, agrees to sign additional releases/waivers and/or provide additional documentation, as may be required by Sponsor.

- Agrees to make himself/herself reasonably available to participate in PR activities and/or interviews or other promotion-related activities, as requested by Sponsor.

- Understands that the Ultimate Driver Test as well as any activities happening while the Each finalist is in Thermal, CA., may be filmed, photographed and otherwise recorded by Sponsor (“Challenge Footage”) and that Sponsor shall own all rights, titles and interests in the Challenge Footage. Each finalist understands that Sponsor, its designees, successors, assigns and licensees, shall have the right to edit, modify, reproduce, distribute, display, perform, create derivative works based upon, or otherwise exploit the Challenge Footage and all elements embodied therein, along with each finalist’s name, biographical information, likeness, performance, voice or image, in whole or in part, together with other materials, in any manner or media now known or hereafter devised (including, without limitation, posting the Challenge Footage on Sponsor’s websites [including, but not limited to, its social media pages or accounts]), throughout the world in perpetuity for advertising, promotional and other purposes, without further compensation, notification or permission. Sponsor has no obligation to make use of the rights granted herein.  Note that Released Parties (as defined below) are not responsible for any unauthorized use of the Challenge Footage by third parties.
 
If a Finalist is not or does not comply with these Event Rules, he/she will be disqualified and, at Sponsor’s discretion, the applicable alternate Finalist will be notified. 
 
FINALIST Prize:
A two (2) day/one [1]) night trip for winner to Thermal, CA., to compete in the Ultimate Driver Test. All Finalists will compete against each other in the same activities to determine BMW’s Ultimate Driver. Exact details of activities and Ultimate Driver Test will be provided to Finalists prior to booking travel.  Prize includes round trip, coach-class air transportation for winner from a major airport near winner’s home (as determined by Sponsor in its sole discretion) to a major airport nearest Thermal, CA., (determined by Sponsor in its sole discretion), one (1) night standard accommodations at a hotel determined by Sponsor (one [1]) room, double occupancy) and three (3) daily meals. Approximate Retail Value (“ARV”): $3,000 each. Actual value of trip may vary based on point of departure. Finalist will not receive difference between actual and approximate retail value. Finalists must travel on dates specified by Sponsor or prize will be forfeited and Sponsor will have no further obligation to Finalist. Travel and accommodations are subject to availability and blackout dates. Travel must be round trip. Sponsor will determine airline and flight itinerary in its sole discretion. Finalist is responsible for obtaining all required travel documents. No refund or compensation will be made in the event of the cancellation or delay of any flight. Travel is subject to the terms and conditions set forth in this Challenge, and those set forth by the Sponsor’s airline carrier of choice as detailed in the passenger ticket contract. All expenses and costs associated with prize acceptance and use not expressly stated in the package description above as being provided, including, but not limited to, ground transportation, meals, incidentals, gratuities, passenger tariffs or duties, airline fees, surcharges, airport fees, service charges or facility charges, personal charges at lodging, security fees, taxes or other expenses are the responsibility solely of Finalist. Travel restrictions, conditions and limitations may apply. If in the judgment of Sponsor, air travel is not required due to Finalist’s proximity to prize location, ground transportation will be substituted for round trip air travel at Sponsor’s sole discretion and no compensation or substitution will be provided for difference in prize value. Sponsor will not replace any lost, mutilated, or stolen tickets, travel vouchers or certificates. If, for whatever reason Sponsor is unable to provide any prize component, no compensation or substitution will be provided; however, remainder of prize package will be awarded and Sponsor will have no further obligation to finalists. Prizes are non-assignable and nontransferable and cannot be redeemed for cash. Prizes are awarded “as is” with no warranty or guarantee, either expressed or implied. Finalists responsible for all federal, state and local taxes (including income and withholding taxes) associated with prize acceptance and use not specified herein as being provided. Finalists may not substitute a prize, but Sponsor reserves the right, in its sole discretion, to substitute prize (or portion thereof) with one of comparable or greater value. All prize details are at Sponsor’s sole discretion.
 
GENERAL CONDITIONS: 
Void where prohibited. Challenge is subject to all applicable federal, provincial, state and local laws.  By participating, each participant agrees to release, discharge and hold harmless Sponsor, its parent, subsidiaries, affiliates, BMW Centers and advertising and promotion agencies and all of their respective officers, directors, employees, representatives and agents (collectively, “Released Parties”) from any and all injuries, liability, losses and damages of any kind to persons, including death, or property resulting, in whole or in part, directly or indirectly, from participants’ participation in the Challenge or the acceptance or use of the prize, including any travel or activity related thereto. Released Parties are not responsible for errors or difficulties of any kind, whether human, mechanical, electronic, computer, network, typographical, printing or otherwise, relating to or in connection with the Challenge, including, without limitation, errors or difficulties which may occur in connection with the administration of the Challenge, the timing of laps, the announcement of the prizes or in any Challenge-related materials. Persons who tamper with or abuse any aspect of the Challenge, who act in an unsportsmanlike or disruptive manner or who are in violation of these Event Rules, as solely determined by Sponsor, will be disqualified. Should any portion of the Challenge be, in Sponsor’s sole opinion, compromised by nonauthorized human intervention or other causes which, in the sole opinion of the Sponsor, corrupt or impair the administration, security or fairness; Sponsor reserves the right at its sole discretion to suspend, modify or terminate the Challenge.
